Nicklaus Misiti files lawsuit in Federal Court, seeking damages in excess of $300,000 for Defamatory Comments posted on Ripoffreport dot com

Nicklaus Misiti, Esq. of Misiti Global, PLLC filed a lawsuit in the US District Court, Eastern District of New York seeking damages in excess of $300,000.000 for violations of the Anticybersquatting Consumer Protection Act (“ACPA”) and violations of RICO laws against extortion and wire fraud. A subsequent criminal complaint was also filed with the Federal Bureau of Investigation (“FBI”).


In June, 2010 a defamatory post was placed on ripoffreport dot com falsely accusing Nicklaus Misiti of among other things committing fraud and being criminally investigated. Neither of these events ever happened, as the false report was posted by a competitor to ruin the good name of Nicklaus Misiti and his law firm Misiti Global, PLLC. Misiti Global has an A rating from the Better Business Bureau and numerous positive testimonials throughout the internet.


In March, 2011 Nicklaus Misiti entered into conversations with a purported Search Engine Optimization (“SEO”) expert to remove the ripoffreport. During these conversations it quickly became evident the SEO was a fraud and Nicklaus Misiti declined to hire him. As a result the purported SEO expert stated that he would create 3 websites: nicklausmisiti dot com, nicklausmisiti dot  org, and nicklausmisiti dot net and would post defamatory content on said sites. The purported SEO expert further stated he would only remove such sites and the false content for a definite sum of money.


Nicklaus Misiti refused these demands and the sites with the false statements were created in violation of the ACPA and various RICO statutes. Thus, in June, 2011 Nicklaus Misiti filed a complaint with the Eastern District of New York seeking a money judgment in excess of $300,000 for damages and ordering transfer of the domain names to his possession. The case is currently pending and the FBI has an ongoing investigation into the actions of the defendant.
